Nightcap Phoenix Rises Again in Qld Federal Court

During the winding up of the company Wollumbin Horizons in Qld Federal Court, Vincent's liquidator Steven Staatz watched the phoenix fly when he sold the contested property to Nightcap's NCV Enterprises for $2 million.

The contested property at 3222 Kyogle Road, Mount Burrell, was sold by the liquidator in 2020, but most of the 37 claimants heard nothing until, more than two years later in November 2022, we were served with an interlocutory application filed by the liquidator in Qld Federal Court.

Steven Staatz is seeking orders for payment from the proceeds of sale of the land to himself first, in priority to supposed beneficiaries. If his application is approved by the Court, the proceeds from sale of the property and interest gained, as Staatz sat on the funds for more than two years, will be almost entirely disbursed to the liquidator and the lawyers.

By order of Derrington J, anyone wanting to be heard upon the relief sought in the plaintiff’s interlocutory application was obliged to appear, either in person or by lawyer, at a case management hearing at Brisbane Federal Court, 9 am, 13 December, 2022.

At this hearing Derrington J made the following orders:

"-- The plaintiff file written submissions in support of the amended interlocutory application by 4:00pm on 21 December 2022.
-- The plaintiff send a copy of its written submissions to those parties who have indicated an interest to be heard on the application by 4:00pm 22 December 2022.
-- By 4:00pm on 25 January 2023 any other party asking to be heard on the application file and serve on the plaintiff their written submissions.
-- The amended interlocutory application be listed for hearing at 9:30am AEST on 2 February 2023."

As a judgement creditor and defendant, ever since the liquidation was initiated in 2018, I have always expected to see the lion's share of proceeds from the sale gobbled up by legal vultures and the liquidator, after orders granted him a lien over the asset:

Google Corp has summarily removed ten posts from Nightcap Nightmare Blog, in response to a request by Rose Litigation's lawyer Billy Fitzgerald, who represents the sovereignty activists running the Nightcap venture discussed in this blog.

Although the censored posts do not name Mr Fitzgerald's clients, the offending posts have been censored because they supposedly violate injunctions imposed by NSW Supreme Court on the co-author and editor, Gi Linda, who is prohibited from imputing felony to Mr Fitzgerald's clients.

The injunctions are based on a 2020 Supreme Court decision by Fagan J that although more than twenty investors lost life savings amounting to over $2.5 million after they provided equity, loans and purchase money for land in 2014-16, receiving nothing in return, this represents incompetence by Mr Fitzgerald's clients, not fraudulent deception.

Nightcap Nightmare Book in Progress

Nightcap Nightmare is a book in progress, compiled by those ensnared in a land-share community at Mt Burrell, NSW. Compiled by Gi Linda, the book spotlights a communitarian venture run by sovereignty activists who are selling "tribal title" to dwelling sites without development approval, on properties taken from those who paid for the land. It tells how shareholder deals were made with neighbouring landowner Peter van Lieshout, brother of billionaire developer John van Lieshout, before revealing plans to extend aboriginal sovereignty claims across the nation.

The land-share scheme began in 2014 as an intentional community called "Bhula Bhula Village Community," promoted by Mark Darwin through Truthology and Freedom Summits. When the sovereignty activists seized control of the properties, more than twenty families lost life savings totalling over $2.5 million.

Nightcap Nightmare is a compelling true account of the resilience of a group of angry creditors and their quest for truth and justice on the tilted stages of Australian Courts.
